1. INTRODUCTION, ARBITRATION NOTICE & CLASS ACTION WAIVER
This User Agreement outlines your rights and responsibilities when accessing, visiting, or using the Service provided by Mid-Century Gems (MCG), herein after referred to as MCG. It does not apply to websites, apps, destinations, or other offerings that are not owned or controlled by us, even if they are linked to the Service. Any capitalized terms not otherwise defined in this User Agreement are explained in the Glossary.
You can access this User Agreement at any time through the footer of the Service's home page, the menu icon, the Service description screen, or as otherwise indicated based on the Service you are using. By purchasing a Product, registering for any aspect of the Service, or otherwise accessing, visiting, or using the Service, you acknowledge and agree to be bound by this User Agreement. If you do not agree to these terms, you should not access, visit, use the Service, or request or receive a Product. We recommend printing or saving a digital copy of this User Agreement for your records.
In addition to this User Agreement, please review our Privacy Policy and any additional terms and conditions that may be posted elsewhere in the Service or communicated to users. These documents are also part of the Agreement between you and MCG.
This User Agreement may be updated periodically, so we encourage you to review it regularly. To notify you of changes, we will update the “Last Updated” date at the beginning of this document. For significant changes, we will post a prominent notice on the Service. Your continued access, visitation, or use of the Service, or continued receipt of a Product, indicates your acceptance of any changes or revisions.
ARBITRATION NOTICE AND CLASS ACTION WAIVER: EXCEPT FOR CERTAIN DISPUTES DESCRIBED IN SECTION VIII(G), YOU AGREE THAT ALL DISPUTES BETWEEN YOU AND MCG WILL BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION. BY ACCEPTING THIS AGREEMENT, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. SEE SECTION VIII(G) FOR DETAILS.
If you breach, violate, or fail to comply with any part of this Agreement, we may terminate, suspend, or restrict your account/profile, your access to the Service, and/or the Agreement itself, with or without notice, in addition to any other remedies available to us. We may also refuse future access to the Service or any Product. Additionally, we reserve the right to take any technical, legal, or other actions we deem necessary to enforce the Agreement and address violations. You agree that we may seek an injunction, without posting a bond, to prevent or address breaches of your obligations under this Agreement.
In the event of a conflict between this User Agreement and any other terms applicable to the Service, we will determine, at our sole discretion, which terms take precedence. By accepting this Agreement, you waive any right to dispute such determinations.
II. MONITORING & COMPLAINTS AGAINST OTHER USERS
1. Monitoring
We are committed to providing an enjoyable online experience for our users, and as part of this effort, we may monitor activity on the Service to ensure compliance with the Agreement. By using the Service, you explicitly consent to such monitoring. However, we do not guarantee:

That the Service, or any portion of it, will be monitored for accuracy or inappropriate use.

That apparent statements of fact will be authenticated.

That we will take any specific action (or any action at all) in response to disputes regarding compliance or non-compliance with the Agreement.
While we generally do not pre-screen user-generated Content, you may encounter Content that is opinionated, offensive, or otherwise inappropriate, including material that violates the Agreement.
2. What to Do if You Have a Complaint Against Another User
By accessing publicly visible portions of the Service, you acknowledge the possibility of encountering Content that may be opinionated, offensive, or inappropriate, including Content that may violate the Agreement. Not all such Content is actionable. Complaints against other users cannot be used to settle personal disputes. For legitimate complaints, please follow these guidelines:

Harassment: If you believe another user is engaging in harmful behavior (e.g., impersonating you, stalking, bullying, threatening, or otherwise harassing), we recommend contacting your local authorities or appropriate state or federal agencies.

Copyright Complaints: If you believe your Content has been copied or is accessible on the Service in a way that infringes your copyright, or if the Service links to third-party Content that infringes your copyright, please refer to the "Copyright Complaints" section below for instructions.

Cybercrime: If you suspect you are the victim of an online crime such as identity theft, fraud, infringement, or hacking, you may report the issue to the Internet Crime Complaint Center at www.ic3.gov, a partnership between the FBI, NW3C, and BJA.
IMPORTANT: Making false or inaccurate accusations of criminal activity, inappropriate acts, or Agreement violations can result in civil and/or criminal liability, including damages, court costs, and attorneys' fees.
III. REGISTRATION AND ACCOUNT/PROFILE CREATION
1. Registration Information
We may require you to register for certain Products (e.g., contests or surveys), make purchases, or create an account/profile to access specific portions of the Service or the Service as a whole. This process may involve providing a User ID, password, and payment details (e.g., credit/debit card information). Other requested details may include your name, phone number, email address, and preferences. Registration information collected through other methods (e.g., social media, email, or SMS) is also included under this Agreement.
You agree that all Registration Information you provide is accurate, complete, and up-to-date. Misrepresentation, impersonation, or falsification of identity is strictly prohibited. It is your responsibility to update your Registration Information as needed using the Service’s mechanisms or by contacting us via the details outlined in our Privacy Policy.
We are not responsible for verifying your Registration Information, and failure to maintain accurate, complete, or up-to-date information may result in critical communications not reaching you.
We reserve the right to modify, revoke, or require changes to your User ID, password, or any other Registration Information, with or without notice. Additionally, we may restrict access to the Service or specific Products if necessary.
You are solely responsible for maintaining the confidentiality of your Registration Information. Sharing or authorizing others to use your Registration Information is prohibited. Unauthorized access, visitation, or use of another user’s Registration Information is also forbidden.
If you suspect your Registration Information is compromised, update it promptly using available tools or notify us via our Privacy Policy Coordinator.
2. Fees & Payments
We and Third Party Providers may charge Fees for accessing certain Products or portions of the Service. By using the Service, you agree to pay applicable Fees at the current rates for the billing period. All Fees are quoted in U.S. dollars unless otherwise specified and are non-refundable unless explicitly stated.
When you provide payment information, you authorize us and our Third Party Providers to store and charge applicable Fees to your designated method of payment. If payment fails (e.g., chargebacks), we may:

Demand immediate payment of any outstanding balance.

Impose a late fee (up to 1.5% or the maximum allowed by law).

Take necessary legal action to collect unpaid Fees, including court costs and attorneys' fees.

Charge alternative payment methods you have on file.

Suspend or terminate your account or restrict access to the Service or Products.
You are responsible for ensuring all necessary devices, equipment, and services (e.g., internet or mobile data plans) to access the Service are maintained at your expense.
